Bankruptcy as a Debt Management Solution: Why Do so Many of Us Have so Much Debt?

In 2004, 1,562,174 Americans sought protection from creditors through bankruptcy court – a per capita rate over ten times higher than during the worst years of the Great Depression! According to the Consumer Federation of America, in 2003 alone over 9 million consumers made initial calls with a credit counseling agency and in 2004 close to 2 million consumers were actually enrolled in varying types of assistance plans. These numbers clearly indicate that personal debt in the United States is higher than it has ever been and financial stress is very much a reality for millions of Americans, across all segments of society.

But how did this come to be? The economy has been relatively strong for over a decade so it can’t be about slow economic cycles. Why are so many Americans finding it difficult to handle debt loads? Is bankruptcy the inevitable conclusion for many of us? All financial experts are in agreement that in most cases, bankruptcy is not a pre-ordained outcome if help is sought early. However, given the type of consumer driven society we live in today, there is nothing to suggest that the rate of bankruptcies is going to decline.

IT HAS NEVER BEEN EASIER TO GET CREDIT

Personal debt in this country has now surpassed the 1.7 trillion dollar mark and continues to soar. 1995 was the first year American consumers used credit cards more than cash in the economy and there has been no looking back. The financial services sector is an extremely competitive multi-billion dollar industry and financial institutions are falling over each other to try and sign consumers up to their credit services. The average household receives 20 unsolicited credit card invitations each year and many of these offers require no credit check, credit history review or income verification. Today, the average American family carries 12 different credit card accounts and we seem to be using them all!

And if it wasn’t enough that the financial services companies are trying to tempt everyone with credit they might not be able to afford, retailers have also joined this game. Merchant specific credit cards were originally introduced as a way to gain customer loyalty by providing a convenience when shopping at the same store. As major ticket consumer goods have risen in price, retailers have had to come up with innovative ways to keep moving these products. Advertising no down payments, or no payments for a full year has appealed to our collective desire to enjoy today and pay tomorrow. It has allowed retailers to continue moving their products and whether planned or not, has resulted in a new cash cow because most people don’t pay off their cards every month. In fact, 88% of all consumers who buy products under deals where there is a grace period before any payment is due or interest is charged end up converting and keeping the amount on their credit cards. At interest rates of between 20 and 30% for most retail cards, this has become a very profitable activity for the merchants.

This last point bears further analysis. Financial institutions and retailers offering credit terms make an enormous sum of money on interest fees and late payments. Again, consider the average American household. The debt carried on those 12 credit cards equates on average to $8000.00 dollars. According to VISA, 48% of us cover only minimum payments from month to month so assume for this example $200. Provided these cards will not be used again for any additional purchases and using an average annual interest of 18%, it will take 62 months to pay down this debt at a total cost of $12,307.37. That is an additional $4307.37 in interest payments over 5 years or fully 35% of the money paid to clear this debt! No wonder lenders don’t mind minimum monthly payments.

PERSONAL DEBT LEVELS HAVE NEVER BEEN HIGHER

These developments have had a huge impact on consumer buying habits. Since 1990 the average American family’s debt load has increased by a whopping 46% (figure adjusted for inflation). It is no longer necessary to save up before buying something; credit is available for almost anyone and just about everyone is using it. The advent of the internet is also making it much easier to spend money. A click of a button, a credit card number and that new product you happened to find while surfing is delivered to your door a couple of days later. You don’t even have to get dressed to go shopping anymore! It has simply never been so easy to get material products or so challenging to adhere to the kind of fiscal self-discipline that is needed to stay out of debt in today’s society.

According to the American Bankruptcy Institute, personal bankruptcy is most often accompanied by either family breakdown (divorce), unexpected medical bills or sudden job loss. These are circumstances largely out of an individual’s control, but the primary difference in today’s society is that because the debt level being carried by most families is so high, there is no longer any savings for those “rainy days”. A survey conducted by MetLife supports this contention with its findings that fully half of all households in the United States live from paycheck to paycheck. If the average family is financially extended like this, it is no wonder bankruptcy may be the only option when sudden changes like divorce, medical bills or job loss occur.

This is no longer a phenomena of one particular segment of society. No household should feel ashamed or be under the impression that they are alone. But in order to safeguard their financial futures, consumers do need to realize the position they are putting themselves in and what they need to do before it becomes too late for anything except bankruptcy.

If continued spending patterns and money management habits do not appreciably change, the number of personal bankruptcies will continue to skyrocket. And even if this final step may be the only option for some, financial experts do warn that although it will serve to either liquidate (Chapter 7 proceeding) or discharge (Chapter 13 proceeding) debt, the repercussions will last for at least ten years. Any future credit will only be available at the highest interest rates, it may affect approval for insurance policies and even in job selection. Recent amendments to federal bankruptcy legislation have now made it much more difficult to obtain a chapter 7 hearing, so even if bankruptcy is the chosen option, it may still require a repayment plan that does not eliminate a consumer’s debt obligations. Bankruptcy should not be taken lightly.

Given our consumer society, there is no indication that these record debt levels are going to change. It may be harder in future to declare bankruptcy, but that won’t solve the problem. Perhaps what is needed is a tightening up of the credit approval processes so consumers don’t have such easy access to levels they cannot possible sustain given income levels. But as long as lenders continue to earn such high revenues through interest, late payment fees etc. it is unlikely we’ll see change here.

Forgiveness is a state of mind: We can choose to forgive someone at any time just by saying the words – “I forgive you” and say the persons name if you know it. Quite often you feel the release as you do this and feel your energy coming back home to yourself.

You can also forgive yourself for all the people you may have wronged or hurt. Self-forgiveness is even more important than forgiving other. This is because we find it difficult to love ourselves if we are blaming ourselves for some event that may have happened in our lives.

This process is all about putting you back in the driving seat of your life. Re-centring your energies in the Now moment. That means not thinking about the past or future but being aware in this moment, knowing that all possibilities are open to you within this moment.

If you are already a kayaking enthusiast or just doing some research and looking to enter the sport, it is important to purchase the right clothing and accessories to keep yourself safe and comfortable on the water! When in a kayak, it is a given that you will get wet occasionally either from a paddle splash or flipping over. The unfortunate part about capsizing is it can happen in any waters and surprise you when you quite suddenly. Clothing for kayak use should be loose and quick drying. Jackets should feel loose and comfortable, and they shouldn’t restrict any torso movement when you sit down in your boat. There is some excellent technology on the market when it comes to synthetic materials that will dry quickly and keep you warmer and more comfortable than even most wool products. For hot summer months, kayak clothes can be cotton, because once they’re wet they stay that way and keep you cool. However for summer, try to avoid cotton underwear, as it tends to chafe. Most boaters find it better to wear a nylon swimsuit under their layers even when it is cooler.

Kayaks are fun on many types of water but be prepared for temperatures to be cooler than on land, especially from wind on larger bodies of water. Also pay close attention to the water temperature, as this is the most important consideration when you pick out your kayak clothes. In the springtime, lakes, rivers and bays can be an icy cold 40, which is enough to rob you of your full strength in only a few minutes after immersion. Also, no matter what type of water sport you choose, make sure you have strong swimming skills as this will go a long way for peace of mind.

Depression Suffering

The ‘experts’ have tried to evaluate me as a sufferer of this but found no such evidence or behavior. The same was true for all other mental or medical conditions, so they think ‘witch’ covers my condition in life; because I refuse to participate in the materially managed environment any more. We will not explore the horrors of the current forms of Inquisition in great detail in this book as it relates to me. That would definitely be too serious and intense, as I would explain society’s role in tortures such as I witness all around me every day. I have been thwarted in devious gambits by those who have something even worse than the strait-jacket as we have seen Drs Breggin and Cohen describe in ‘Science’. They call it (appropriately) ‘pharmacological lobotomies’. ECT is even more disgusting and joins Ritalin in a campaign which social forces are developing in this control paradigm. It seems relevant to point out enough of the matter of my experience so that you will know you are getting it pretty close to what they say when they use the phrase ‘the horse’s mouth’.

Even the pharmacological and psychiatric conglomerate acknowledges the physical elements of depression. Some are cluing in to nutrition and massage or simple caring. The effects of education and alienation are massive, but bad parenting and the lack of enabling nutritive support in early life establish character and behavior traits that stubbornly resist real therapeutic methods. These obsessions often are far too time-consuming for high-paid ‘professionals’ to offer assistance – so we just drug and deceive! This medical model as some call it makes a great deal of money and keeps the public at large thinking something humane is going on in the life of the care-givers and victims of a society without true spiritual awareness and far too little compassion. The buzz words and catchy phrases like ‘informed consent’ are not anything more than deceit, as they still give lobotomies. In one case they did it without informing the person who just died in 2005.

Francis Mark Mondimore writes a book called ‘Depression, The Mood Disease’ updated in 1993 by Johns Hopkins University that presents the lies of this machine that Ivan Illich (in ‘Limits To Medicine’) identified as ‘mechanistic and over-professionalized’ in the mid 70s.Here is the overstatement of the century from its inside flap:

“The revised ‘Depression, the Mood Disease’ tells readers exactly what they need to know about the causes, symptoms, and treatment of depression:

*How antidepressant drugs were discovered, how they work, and with what side effects. {I’m biting my tongue!}

*What Seasonal Affective Disorder (SAD) and panic attacks are, and how they are treated.

*How electro-convulsive therapy has changed for the better–and why it now works for up to 90% of those treated. {And all the professions involved in continuing to provide this fearsome horror that is necessary to repeat as it continues frying brain cells. Now randomly due to a drug cocktail, so that people’s libido and zest is burned out too.}

*How the special problems of depression in children and older persons are handled. *How to deal with a depressed friend or family member.

*How such disorders as hormonal imbalance and even lead poisoning can ‘mimic’ the symptoms of depression.

*Why depression is sometimes misdiagnosed as ‘PMS’, drug abuse, or Alzheimer’s disease…” (2)

The future holds promises and terrors galore in the application of ‘easy’ answers like drugs developed for specific genetic make-ups and nanites to monitor and deliver targeted drugs or shocks to the system in order to make us behave as we should. The ever-increasing ‘big brother’ that allows the growth industries associated with the management of people will lead to full employment if we allow it to continue down the current path. There will only be one benefit as the unemployable grow in number and the employment roles show full employment. The statistics will show the economy is productive and there is little unemployment or reason to worry about an economic depression. That is the end of the excerpt from my encyclopedia. I will be including some other more recent writings as we proceed.

I had returned from the Caribbean and a failed business experience in Mexico and Belize in the month of March 1998. My last wife and I had purchased a yacht, which we hoped to be able to build a party boat/tourist business around. My wife had named the boat ‘Champagne Dreams’ after the motto of Robin Leach’s show ‘The Rich and the Famous’. It was her idea that we put a Jacuzzi on the front deck, of this 47 foot fiberglass yacht that we purchased in Fort Lauderdale, and our partner (Captain Crunch) Jerry had taken with me to Cancun. His nickname had not been established until we were leaving Key West. He destroyed the fueling station of the marina while hitting three other boats. We were still married though it was never a real marriage as most people think of it. The relationship was already complicated with another man named David.

It is not the purpose of this book to try to describe the trials and tribulations of a relationship between myself and a young Vietnamese exotic dancer who had been one of the ‘boat ‘people’. Suffice it to say there were many exciting times that had lead me to the point where I was ready to leave this world before I even met her. I had been a self-made millionaire at the age of thirty. My travels and business had allowed me to meet some of the most interesting people. By any standard of measurement most would agree I had enjoyed life FULLY. My interest in psychology due to having grown up with a schizophrenic mother had long before gotten into the realm of Eastern mysticism and parapsychology.

We had gone to Cancun in early September of 1997 to further research a stele that I had found at Chichen Itza four years before with my previous wife. This event had ended with my being thrown off the site, and having to sign a document giving the Mexican authorities the right to throw me in a Mexican prison, without any recourse to the courts and Canadian law. This is truly a story of oppression of the Mayan and native people of Central America that includes a deceit of history which is IMMENSE! We had been doing a non-invasive charcoal rubbing of this ’stele’ (stone for heavenly worship, or library in stone). It had been painted over twice and it seemed the white surface would have made the pictures provide insufficient clarity. So we had some paper we were using over the stone to capture the alphabet that had not ‘come out’ in the previous photos I had taken four years earlier when the granite ‘rock’ had its original shiny surface.

This alphabet I believe confirms the work of Col. Churchward, the author of ‘The Lost Continent of Mu’, who documents the Cara-Maya language is the translational medium through which the Greek alphabet on the other side of the ’stele’ tells the story of the destruction of the civilization that originally colonized South America some sixty thousand years earlier. I believe Col. Churchward would agree with my statement that the original colonization had started during the Riis-Wurm geologic Ice Age, and was finalized during the last Ice Age; if he had the benefit of recent geologic and archaeologic evidence. A fellow researcher and good friend named Brenda found this in Islam and Sufism which applies to my personal quest.

A pupil becomes afraid in facing a choice between two roads, but a shaikh advises getting rid of fear so that either road will be good. The Hoopoe tells the eighth bird that only if death ceases to exercise power over creatures would it be wise to remain content in a golden palace.” (3)

Make the Most of Your Peel Off Stickers

Don’t you find it maddening when you peel an outline sticker from the sheet and notice that the bits left behind also make a great picture, if only you could peel them and put them in the right place to recreate the picture. Well now you can.

All you need to do is stick a piece of masking tape onto the remaining pieces then peel it carefully to lift the pieces from the backing sheet. PLace the image where you would like it, then rub vary hard onto the back of the masking tape. The image should stick to your project allowing you to remove the masking tape.

So to make a beautiful card with a butterfly outline sticker. Select an A5 piece of Coloured card, fold it in half. Select a piece of background medium in a matching colour and mount this onto the front of your card. Then simply peel the Butterfly and place on your card, you can then colour the wing sections in different colours to great effect.

You can then use the above method to add a second butterfly shape from the middles of your first butterfly.

To finish your card you could add a plain paper insert and a matching C6 envelope.

Those Who Can Control Their Mind, Can Control the Whole World

What we think about the world and how we perceive it all depends on our mind. For realizing and reacting in this world, mind is the most important thing for us. Our mind is like a processing system of computer which gathers all the information and makes us to react in a particular way. The software’s for this computer are our perceptions and conditionings. After analyzing all the situations, our mind work according to these conditionings. The main problems come when we totally go into the control of brain and spoil our lives.

Over conditionings and perceptions stops our power to think and analyze the situations. Therefore many of the decisions which we take are not actually taking by us. They are taken by our mind without making us realize about all this. We become so much burred in these conditionings and perceptions that we do not realize our decisions are taken by our mind. We accept all these decisions as our own decisions. Mind has immense power to create and present things.

It can make us happy for driving a car and at the same may make us unhappy for not having an expensive car. If we are not in the control of a mind then we will never indulge into these comparisons. Some divide mind in to positive and negative. They say we should be in positive frame of mind. However the question still remains that we depend on mind and mind can take u-turn any time. Mind is very smart in creating limits. If we start accepting these limits then we will find our selves in many difficulties.

It is the right of every human being to realize his true self. True self has amazing powers. It can guide us better than mind in life. Moreover the decisions taken will be our own and not of our mind. And when we come out of our mind then simultaneously we come out of the control of this world. True self make us to take smart and good decisions. All our behaviors and thoughts become what we want them to be. Our mental health becomes stronger and we mostly take good decisions.

Over Regulation and Over Lawyering Killing American Commerce

Well I have retired at 40-years old and it is not because I am lazy, stupid or want to kick back. It is because I just got tired of beating my head against the wall filling our forms, dealing with all the over regulation in industry and then having to watch lawyers over charge and take all the cream off the top. Personally I think Caesar was right and Vice President Dick Cheney who popped one full of Bird Shot is now my personal Hero.

While in the Franchising Sector as a Founder, I cannot tell you the amount of over regulation we had to deal with. But that is only one industry. How about doctors and malpractice and those suits affect our health insurance rates, sure some doctors are really incompetent just like some lawyers are incompetent and I have even met franchisors that are incompetent as entrepreneurs.

But in all if their were fewer lawsuits and everyone could do handshake deals like our grandparents then in fact business, educational systems, police protection could move smoother with less red tape and better results. Government’s number one job is to protect her citizenry, yet we constantly interject attorneys and lobbyists into the loop for special interest group’s rights, without actually serving the people our leaders are sworn to protect.

Why should a mobile car wash business franchise need a 210-page pre-sale legal disclosure document? It doesn’t, but over the years the average franchise documents have increased and ours is actually on the low side. The bigger they get the less they help the customer (franchisee), and give more power to the Corporation. That is truly a travesty. What an insane amount of paperwork for the privilege of creating opportunity, jobs, tax base and providing consumers with their desires. What a way to repay the greatest asset in our nation. It is the ultimate disrespect for those who give 110%.

Work from home can be an employee’s dream, especially if you are a person who has a long drive, or who hates to be tied down to the office. In addition, if you are more of an independent worker, work from home could be the answer.

Work from home job is not easy. You should feel responsible about the work given to you by the employer and complete in time. So that the employer can trust you and can go to give more good work. Most work from home employers put in more than their share of 40 hours of week like regular home to work employees.

They must prove themselves. It seems at times that no matter what they do, there is always a slight element of mistrust from the work from home manager regarding the work from home employee’s work habits. Is she watching TV instead of working on the company report? Is he taking a two hour lunch and only documenting one hour? Because of this work from home mistrust, work from home telecommuters need to work harder, no matter if they are glued to the computer or their home office 8 straight hours a day.

Boundary between working and Playing
It is important to first understand that like your office at work is only for work, your work at home office at home is also only for work. Do not mix work and play together. Keep the two separate.

This can be difficult if you are a work from home mother or father who has no daycare available for the kids. What to do? In addition, take your work from home lunch and work at home breaks outside of your work from home office. When typography is used creatively, it can accurately express and illustrate emotion and create a mood. Letterforms can be elegant and even visually exciting when used correctly. In the way letters are shaped for headlines and logos, they can reach out and get a reaction out of someone. When typography is used as an art form, it does not necessarily have to be read; in fact, it can stimulate the eye and carry a message without ever needing to actually read it.

When letter shapes are emphasized and become part of the overall design, graphic designers don’t have to rely so heavily on actual pictorial illustrations. In fact, some artists use typography as texture in the background of their layouts, or they use typography to create forms in the foreground. When color is added to typography or different weights or movements are given to it, all font families take on their own unique style. As found in many advertisements and logos, standard fonts can look extremely artistic. Most importantly, when typography matches the mood of the layout and appeals to the audience it was made formission is accomplished! The style of typography should support the visual communication and help illustrate the meaning behind the text. In other words, headings should mimic and complement the mood and setting of a layout.

Another factor to consider when designing a layout is to address the target audience you are looking for. For instance, if your audience is for young children, the typography should consist of playful shapes and colors.
